I don’t bother with ‘rights’ arguments because there’s no need. Math trumps rights. I don’t even think the 2nd Amendment matters anymore, because there’s no way anyone could magically evaporate all the guns even if they wanted to. 40% of the firearms in the entire solar system are in the hands of private US citizens, and our military can’t even properly occupy Afghanistan after twenty years. You’re not getting the guns back anyway. That would be a True Thing That Is True whether I was pro gun or anti gun.
That said, the constitution was not technology specific. The first amendment applies to advances of digital expression in the same way the second amendment applies to advances in firearms, and for the same reasons.
